3. WARRANTY

3.1 gpsauto.ee provides a limited warranty on all offered products.
3.2 The warranty period is valid from the moment of transfer indicated on the invoice.
3.3 Warranty repairs carried out during the warranty period do not extend the warranty validity.
3.4 The products sold by gpsauto.ee are subject to a 2-year claim submission period stipulated in §218 subsection 2 of the Law of Obligations Act.
3.5 For clients who are legal entities, the warranty period is determined by the device manufacturer or wholesaler (importer).

4. TERMS OF PURCHASE

4.1 GENERAL TERMS

4.1.1 These terms apply to the legal relationships arising between gpsauto.ee customers and the owner company of the gpsauto.ee online store, Ravolar Grupp OÜ, in relation to the products purchased from the gpsauto.ee online store.
4.1.2 In addition to these terms, the legal relationships arising upon purchasing from the gpsauto.ee online store are regulated by the laws in force in the Republic of Estonia.
4.1.3 gpsauto.ee has the right to change and supplement these purchase terms and the price list due to the development of the online store and in the interests of better and safer use of the online store. Changes and supplements are announced on the website gpsauto.ee. Changes and supplements to the purchase terms and price list come into force from the moment of their publication on the website gpsauto.ee. If the order was submitted before the changes to the purchase terms came into force, the terms that were valid at the time of submitting the order apply, unless otherwise provided by law or these terms.
4.1.4 The assortment of goods and prices change without prior notice.
4.1.5 The quantity of goods available for purchase is provided with a time lag and may differ from the actual stock.
4.1.6 The gpsauto.ee online store has the right to make discounts on orders and/or specific goods during various campaigns.
4.1.7 After placing an order, the goods are not reserved. The purchase-sale transaction is considered concluded (effective) from the moment the goods are paid for to Ravolar Grupp OÜ.
4.1.8 All operations are carried out during working hours by gpsauto.ee operators.
4.1.9 In addition to these terms, the legal relationships arising upon purchasing products from the gpsauto.ee online store are regulated by the laws in force in the Republic of Estonia.
4.1.10 Disputes arising between the buyer and gpsauto.ee related to orders and purchases are resolved through negotiations. If an agreement is not reached, the parties can turn to the Consumer Protection Board or the Tallinn City Court to protect their rights. In resolving disagreements, the parties are guided by the laws in force in the Republic of Estonia.

4.2 AVAILABILITY OF GOODS, PRICE LIST, AND INFORMATION

4.2.1 gpsauto.ee is a dynamic system reflecting warehouse stock status, updating the availability and prices of goods based on warehouse data not less than once a day.
4.2.2 All gpsauto.ee prices are given in euros (EUR, €).
4.2.3 All gpsauto.ee prices include the value-added tax established in the Republic of Estonia.
4.2.4 Changes in the quantity and price of the ordered goods reflected in the product information come into force from the moment of their publication on the gpsauto.ee website.
4.2.5 The delivery time in the product information is given in working days. The delivery time is approximate and may be extended to a later period for any reason.

4.3 ORDERING

4.3.1 gpsauto.ee accepts orders as follows:

• Online, via the automatic ordering system;

• By phone at +372 66 222 77;

• By sending an order to the address [email protected]

4.4 CANCELLATION OF ORDER

4.4.1 The buyer has the right to independently cancel an unpaid or undelivered order by setting the appropriate status in their profile for the erroneous order.

4.4.2 The order is automatically canceled upon the expiry of the payment deadline:

• For individuals after 2 working days;

• For legal entities after 5 working days.

4.5 FULFILLMENT OF ORDER

4.5.1 The order is fulfilled only after the prepayment has been received, unless otherwise agreed with the buyer.

4.6 PAYMENT FOR ORDER

4.6.1 Possible payment methods:

• Via internet bank link from the gpsauto.ee website;

• By bank transfer (based on invoice);

• By credit card;

• With the accumulated gpsauto.ee bonus amount.

4.7 DELIVERY AND HANDOVER OF GOODS

4.7.1 The buyer can choose a suitable option for receiving the goods:

• After the goods arrive at the gpsauto.ee warehouse and upon receiving the respective notification, come to pick up the goods themselves at the Mugav Auto store (working days 9:00–18:00), located in Peetri, Häälinurme 1;

• Order delivery to any location in Estonia. The goods are delivered according to the deadlines specified in the product information, but these deadlines may be extended due to reasons beyond our control (force majeure). If there are problems with delivery by the deadline, gpsauto.ee customer service will immediately inform the buyer:

  • Depending on the goods, delivery is carried out via courier services or parcel machines;

  • Goods are delivered on working days from 9:00 to 17:00. The courier always calls in advance to confirm the delivery time;

  • If the ordered goods do not fit into the SmartPOST parcel machine, they will be sent to the client by courier.

4.7.2 If the delivery time of the goods is exceeded, please send an inquiry about the order to [email protected]. You will be informed of the reason for the delay and the new estimated delivery time.
4.7.3 gpsauto.ee does not undertake the obligation to compensate for damages arising from the delay of goods.

4.8 PACKAGING

4.8.1 gpsauto.ee recommends keeping the original packaging of the goods in case there is a need for warranty service—as required by some manufacturers. Do not remove the serial number or other necessary information for identifying the goods from the product and its packaging.

4.9 IF DELIVERY OF GOODS IS NOT POSSIBLE

4.9.1 If the price of the goods has changed or they are physically out of stock, making it impossible to deliver the goods within the time specified in the order, gpsauto.ee will inform the buyer using the contact details provided in the order. The buyer will be informed either of the impossibility to deliver the goods or of the new delivery terms of the ordered goods. If the proposed terms do not satisfy the buyer, they have the right to cancel the order. In this case, point 4.12 of these terms comes into effect.

4.10 RETURN OF WARRANTY GOODS

4.10.1 If warranty goods cannot be repaired or replaced, the buyer will be informed, and point 4.12 of these terms comes into effect.

4.11 REFUSAL OF PURCHASE (Note: This point applies only to consumers who are individuals)

4.11.1 If the purchased goods are unsuitable for any reason, the buyer has the right to cancel the purchase-sale agreement within 14 calendar days from receiving the goods (Law of Obligations Act §56 points 1 and 2). When returning the goods, please note that according to the Law of Property Act, the client must compensate for the decrease in the value of the goods resulting from their use. If you disagree with the amount offered by gpsauto.ee, you must cover the costs of expert assessment to determine the decrease in the item’s value.

4.11.2 The returned goods must not be used and must be in the original packaging:

• The buyer must carefully open the original packaging of the goods without damaging it. If the packaging is sealed, the returned goods do not have to be in the original packaging;

• The goods must have all factory stickers, including the serial number;

• In the gpsauto.ee online store, you can familiarize yourself with the goods similarly to a regular store, i.e., you can try on clothes and shoes to ensure they are suitable. However, if you, for example, connect speakers to an amplifier and install them in a car, you can no longer return such goods.

4.11.3 The 14-day right of withdrawal does not apply to the following goods:

• Goods manufactured considering the buyer’s personal needs or special conditions;

4.11.4 If the buyer wishes to cancel the purchase-sale agreement, they must notify the gpsauto.ee online store within 14 calendar days from receiving the goods at [email protected], attaching a photo of the goods and packaging to the email. gpsauto.ee reserves the right to request additional photos of the returned goods if necessary.
4.11.5 The buyer agrees to bear the return shipping costs up to 15 EUR unless the returned goods do not correspond to the ordered ones (e.g., the wrong model was sent).
4.11.6 Upon cancellation of the contract, the purchased goods must be returned immediately (no later than within 30 calendar days).
4.11.7 The buyer agrees that in case of misuse of this point, gpsauto.ee may refuse to serve them in the future.
4.11.8 If the buyer uses their right to cancel the purchase-sale agreement, after returning the goods, point 4.12 of these terms comes into effect.

4.12 RETURN OF FUNDS

gpsauto.ee offers the buyer the following options for the use of funds:

• Exchange for another desired product with recalculation of the order price;

• Transfer of the amount paid for the order to the client’s bonus account in the gpsauto.ee system;

• Refund of the amount paid for the order to the client’s bank account. The refund is made only by transfer and only to the account from which the order was paid. The refund is made no later than within 14 calendar days after receiving the client’s application;

To withdraw from the contract, you need to send an email to [email protected] with the following content:

– Date of placing the order

– Date of receiving the goods

– Consumer’s name

– Consumer’s postal address

– Date

5. SECURITY

5.1 gpsauto.ee is a secure online store where it is safe to shop:

• All order processing and payment operations are secured with a protected connection based on modern SSL technologies;

6. PROTECTION OF PERSONAL DATA

gpsauto.ee follows good practices in personal data protection and is guided by the Personal Data Protection Act:

• Only data necessary for fulfilling the order are requested from the client;

• The client is informed about the transfer of personal data to third parties (e.g., when forwarding a leasing application);

• Delivery data are forwarded by default to courier companies.

7. LIABILITY AND FORCE MAJEURE

7.1 gpsauto.ee is liable to the client, and the client is liable to gpsauto.ee for damages caused to the other party due to violation of these terms, in cases and to the extent provided by the laws in force in the Republic of Estonia.
7.2 gpsauto.ee is not liable for damages caused to the client or for delay in delivering the product if the damage or delay is due to circumstances that gpsauto.ee could not influence, did not foresee, and could not have foreseen.
